last 2 years, as the market has declined. Even though I’ve been through some training on how to deal with banks in potential short sale situations, that is not an area of expertise for me, nor have I been certified to render any credit counseling or to deal with the Loss Mitigation issues and process with the banks. See my disclosure below to better understand the services that you might need. There are no guarantees that your bank will accept a short sale proposal from you. There’s no guarantee that you even qualify for this option. What we can do is help you understand what is needed and help you through the process of negotiating with the bank. If the bank agrees to the short sale, I can also get the house listed and market it aggressively to get you out from under the obligation as soon as possible.

Disclosure Regarding Loss Mitigation Services and Short Sales Services
Loss Mitigation Services involve the processes of negotiating with lenders to avoid a foreclosure and exploring all of the options available to the homeowner and/or negotiating with the lender to gain agreement from the lender that it will accept less than is owed on an existing mortgage, either through a refinancing of the lender’s mortgage loan or through the “short sale” of the property. Neither the undersigned Realtorâ nor his broker has not been trained or certified to render any of those loss mitigation services and neither the undersigned Realtor nor the broker makes no claim or representation that he/she is an expert in that field. Homeowners who need such services should seek the advice of an attorney or from loss mitigation councilors who have been trained and certified (by HUD) to render such advice. HUD is the only Federal Agency chartered to certify councilors for homeowners facing loss mitigation. Homeowners should visit the HUD site at www.HUD.com for more information about the services that are available from HUD certified councilors and to find information about the locations of certified councilors.
The undersigned Realtor is only trained and licensed to provide real estate services, which are outlined in the Agency Disclosure that he/she will, or should have, share(d) with you or which are detailed further in the Exclusive Right to Sell Contract that they will (or should have) have you sign to list your house. If you have not listed your house with the undersigned Realtor, then he/she is not in a position to render any services for you concerning your home, other than providing you with real estate marketing advice that might help you in making the decision to list your home.
If, after consultation with your attorney or a certified councilor, you decide that a short sale is the option that you wish to pursue, the undersigned Realtor is trained and licensed to list your house, place it on the market and provide all of the real estate related services that are outlined in his/her listing contract and the Agency Disclosure. You will still need separately to engage the services of a loss mitigation professional to handle the negotiations with your lender. Your Realtor may be able to provide you with a list of some of those service providers or you may get that from your attorney or from any HUD certified a councilor.
By reading and agreeing to this explanation, Sellers acknowledge and accept that the undersigned Realtor and his broker has disclosed to you that he/she will not be rendering any loss mitigation services, even within the context of listing the house as a short sale, and you agree to hold both the Realtor and broker harmless for any damages or consequences that may arise from acting upon the loss mitigation advice that you have received from other parties. You further acknowledge that you understand that a short sale involves the actual sale of your home and that you will not be receiving any proceeds from such a sale. Further you acknowledge that neither the Realtor nor his broker has made any promises or other representation to you concerning whether the lender will accept the proceeds from such a sale as payment in full for the existing mortgage debt. Sellers should consult their attorney or the loss mitigation service that they have engaged concerning any possible collection actions that the lender could take about the deficiency against the original mortgage.
